Privacy and Spamming is our single most important policy. GoCommerced are strictly against any misuse of both personal information or unrequested contact. As such our Privacy Policy reflects this and is outlined easily for you to navigate.

1. Privacy Policy: Customers signing up, contacting us and registering as a customer.
GoCommerced are committed to protecting and respecting the privacy or all our customers and visitors.
The information collected from customers when signing up is used for billing and administration purposes only and will be kept confidential.
Payment Card Details: We do not ask customers for sensitive information such as credit/debit card details, ever. Therefore payment or card privacy cannot be an issue.
Name, address and personal Information: May be collected via the registration form. This is held by GoCommerced only and is never disclosed to any third party for any reason whatsoever.
Exceptions: Exceptions to the information provided on this page may exist for legal obligations only, where we are obligated by law to provide information.
Website Visitors: When visitors use the website, information such as the ISP's domain, the time accessed and the pages visited will be stored by us. This is to analyse the web traffic and improve content of the site.
Email Addresses & Spamming Policy: We operate a strict 'no spamming' policy and GoCommerced do not contact any customer or potential customer without this being in response to a request for information. This would be gained through the customer requesting contact via our 'contact us' form or by registering for a service where contact from us is expected.
All emails include a clearly defined reporting link and information at the base of each email.
2. Use of our customers information via the website's provided by us.
GoCommerced provide web sites for customers and have tailored sites so that only the information required by that site to perform the required service are included.
Each website is responsible for its own terms and conditions and privacy policy. GoCommerced are not responsible for any incorrect information included on any website that it provides. Any personal information contained within customer's website's and online shops is their own responsibility. The solution is built to provide a minimum collection of information required to provide the service they wish to provide. We have taken security measures to ensure that our customers are protected against loss, alteration or misuse.
GoCommerced are the holder of their information on our servers. This information is not accessed for any reason other than normal maintenance and updates. This information is the responsibility of our customers. Gocommerced have no rights whatsoever to this information and belongs entirely to our customers.
GoCommerced do not use this information in any way whatsoever. We do not use, copy, resell or pass on to any third party any information held in any database for a customer. This includes all information in all areas.
Customers are responsible for ensuring that only authorised personnel access their accounts. If for any reason you are concerned about this, or have any questions regarding our privacy policy or terms and conditions, please contact us via the Contact Us page.
Use of our Emailer service by our customers holds a separate and differing privacy Policy and this is outlined below.
3. The Emailer - privacy Policy and Customer Requirements.
Gocommerced are currently beta testing their new Emailer add-On that is available for customers to use as an additional plugin. This Plugin has a separate set of rules and regulations to those outlined in our normal policy above and some of the terms and conditions may differ to those listed on our main Terms & Conditions page.
Upon signing up for the service you must declare via the application of this product that this products will be used only by you for the purposes of sending newsletters or offers to a bone-fide list of people that have expressly agreed to receive emails from you relating to offers or news.
Each element of the following declaration is agreed by you as you upload a list of email addresses to your solution for sending emails. That the email list is:
- Not a bought or purchased email list.
- That all emails are customers that have expressly signed up via your web site to receive offers or newsletters from you, or are people that have purchased products that you have delivered to them from your online shop within the last 12 months.
Spam Reports from customers receiving your emails:
We operate a policy whereby any person receiving an email from any company using our service are able to inform us if they feel that the email they have received is spam. Although we expect that there will be a certain number of people that will do this anyway, this will certainly highlight any company that we feel is misusing the Emailer to send unsolicited emails.
- In every case where a number of 'spam report' emails are received by us we reconsider the use of the software.
- In every case where that number exceeds the amount we consider acceptable, we remove the use of this software permanently and...
- we will further destroy any uploaded lists included in this software at that time. You agree to this in advance of this software being used and this action is not negotiable.
Choice/Opt-out
GoCommerced Anti-Spam policy tolerates only permission-based email. In addition, users always have the opportunity to opt-out via a link in the footer of all email messages. These options are made available when customers sign-up for emails via any company that then use the GoCommerced Emailer.

As you can see - this option does not provide for people to select preferences - a customer is either agreeing that you can contact them, or not. There is no mistaking the selection a customer makes. If a customer chooses to report you for spam, then that customer sends us a report and at the same time is unsubscribed from your system. This helps to maintain and update your email lists so that you are only holding customers that continue to agree to your emails.
Links
The Emailer is intended to advertise the web site / company news or goods that is renting the use of the Emailer. Therefore, the following restrictions are put into place:
- Links from any email sent are directly to the website that has rented the Emailer - with the rare exception of a (2) below.
- The user agrees that only links to appropriate third party website's that are appropriate, such as a business partner, sister company or similar exceptional circumstance.
- Links to other website's in general are not acceptable. This includes but is not limited to links advertising other companies, Google adwords, affiliate sales, pornography etc.
- Acceptable links should be the minority of links from any email sent and not the majority. Therefore there should be less links to other websites than your own. Where this is not the case, regardless of content and business comparison, we retain the right to remove the service and use of the Emailer.
- Links to any company that is not considered appropriate to what that your business sells is considered spamming and is not allowed.
GoCommerced's Policy
GoCommerced has a no tolerance spam policy. GoCommerced's customer support actively monitors large import lists and emails going to a large number of contacts. Any customer found to be using GoCommerced for spam will be immediately cut-off from use of the product. If you know of or suspect any violators, please notify us immediately here.
Every email contains a mandatory unsubscribe link - it is impossible to remove this link as it is added after the email is sent via the system, and is added by our system automatically.
What is Spam?
Spam is unsolicited email also known as UCE (Unsolicited Commercial Email). By sending email to only to those who have requested to receive it, you are following accepted permission-based email guidelines.
What constitutes a Preexisting business relationship?
The recipient of your email has made a purchase, requested information, responded to a questionnaire or a survey, or had offline contact with you.
What constitutes consent?
The recipient of your email has been clearly and fully notified of the collection and use of his email address and has consented prior to such collection and use. This is often called informed consent.
Isn't there a law against sending Spam?
The federal anti-spam law went into effect on January 1st, 2004 and preempts all state laws. While this new law will not stop spam, it does make most spam illegal and ultimately less attractive to spammers. The law is specific about requirements to send commercial email and empowers the federal government to enforce the law. The penalties can include a fine and/or imprisonment for up to 5 years.
How GoCommerced protects you from sending spam
GoCommerced is a permission-based email-marketing plugin that follows the strictest permission-based philosophies:
- Communication - By accepting our license agreement you have agreed to use only permission-based lists and never to sell or rent your lists.
- Reporting Option- GoCommerced automatically add a link to the bottom of any email you send out via the Emailer that allows recipients to report you to us - consequently, we may remove the use of our system if we receive an unusual amunt of spam reports.
- Unsubscribe - Every email generated from GoCommerced contains an unsubscribe link which allows your contacts to opt-out of future emails and automatically updates your contact lists to avoid the chance of sending unwanted emails to visitors who have unsubscribed.
- Identification - Your email header information is correct because it is pre-set for you by GoCommerced. Your email's "From" address is verified and already accurately identifies you as the sender.
How to protect yourself from Spam:
- Are you importing a purchased list of ANY kind?
- Are you sending to non-specific addresses such as:
- sales@domain.com, business@domain.com, webmaster@domain.com, info@domain.com, or other general addresses.
- Are you sending to distribution lists or mailing lists which send indirectly to a variety of email addresses?
- Are you mailing to anyone who has not explicitly agreed to join your mailing list?
- Have you falsified your originating address or transmission path information?
- Have you used a third party email address or domain name without their permission?
- Does your email's subject line contain false or misleading information?
- Does your email fail to provide a working link to unsubscribe?
- Are you failing to process any unsubscribe requests that come to you via a reply to your email within 10 days or the request?
